Notice on the handling of related problems in the identification of new and old labor capacity standards



The labor and social security department (bureaus) of all provinces, autonomous regions and municipalities directly under the Central Government:


Disability rating of work-related injuries and occupational diseases for workers with ability to work (GB/T16180 - 2006) (hereinafter referred to as the new standard)


It has been approved by the National Standardization Management Committee and will be implemented in May 1, 2007.

The new standard summarizes practice.


Experience has absorbed suggestions from various labor appraisal institutions and various sectors of the society.


The identification of disability degree has been revised and improved.

In order to link up the new and old standards, the smooth pition of the old and new standards is realized.


The following questions are announced as follows:


1. Since May 1, 2007, the labor capability appraisal committee has applied to comply with the regulations on industrial injury insurance.


When the workers who are working on the labor capacity are identified for the first time, they should be carried out according to the new standards.


Two. For the first time, a conclusion has been made before May 1, 2007, and the workers in accordance with the regulations on industrial injury insurance regulations.


After the application is reappraise, the labor capacity appraisal committee shall be appraise according to the new standard after May 1, 2007.


Three. For the conclusion of the appraisal before May 1, 2007, if the injury changes, the workers will be injured in 2007.


After May 1st, the application for re examination and appraisal is carried out according to the new standard.

But the injury is aggravated, and the level of re examination is lower than the original grade.


In addition, the original identification level will no longer be changed.

After the injury has not changed, after May 1, 2007, the applicant will apply for reexamination and appraisal.


Certain conclusions remain unchanged.


Four. For the conclusion of the appraisal made before May 1, 2007, the new standards will be re examined after implementation.


With the increase of disability level, the long-term treatment of industrial injury insurance will be improved correspondingly, and the one-time disability allowance for industrial injury insurance will no longer be adjusted.


Five, in the process of implementing the new standards, all localities can properly handle the implementation of the new standards according to the above opinions.


Specific problems.

In particular, measures should be taken under the precondition of legality to avoid the initial identification before the implementation of the new standard.


Conclusion: after the implementation of the new standard, the new standards will be re identified, and the contradictions caused by the conclusions will be different.
